Chapter 16 — Constitutional Authority

16.1 Purpose

This chapter defines the constitutional authority governing the Engineering Intelligence Platform.

It establishes the source, scope, ownership, delegation, and protection of constitutional authority, ensuring that governance remains stable, traceable, and independent from engineering implementation.

Constitutional authority shall govern the governance system itself and shall not be altered through ordinary engineering evolution.


16.2 Definition

Constitutional Authority is the highest governance authority established by Engineering Constitution Rev.1.

It defines and protects:

  • Governance Principles
  • Governance Responsibilities
  • Governance Relationships
  • Governance Boundaries
  • Governance Lifecycle
  • Governance Decision Gates
  • Governance Authorization

These constitutional elements collectively define the approved Governance System of the Engineering Intelligence Platform.


16.3 Source of Authority

Constitutional authority originates exclusively from the approved Engineering Constitution.

No other engineering artefact, specification, implementation, procedure, repository, automation workflow, or engineering decision may independently establish, modify, or supersede constitutional authority.

Accordingly, Engineering Constitution Rev.1 shall remain the sole normative authority governing the Engineering Intelligence Platform.


16.4 Scope of Authority

Constitutional authority governs the governance framework rather than engineering implementation.

Its scope includes:

  • governance policy;
  • governance structure;
  • governance ownership;
  • governance responsibilities;
  • governance relationships;
  • governance boundaries;
  • governance lifecycle;
  • governance authorization.

Its scope explicitly excludes:

  • engineering specifications;
  • implementation details;
  • software development;
  • hardware realization;
  • verification artefacts;
  • release artefacts;
  • operational procedures.

These artefacts belong to controlled Engineering Baselines.


16.5 Ownership

Constitutional authority is owned collectively by the Architecture Board acting as the constitutional governance authority of the Engineering Intelligence Platform.

The Architecture Board is responsible for:

  • approving constitutional governance;
  • preserving governance integrity;
  • authorizing constitutional evolution;
  • maintaining governance consistency;
  • exercising Architecture Change Control (ACC).

Constitutional ownership shall not be delegated.


16.6 Delegated Authority

Although constitutional ownership remains with the Architecture Board, engineering realization authority may be delegated.

Delegated authority authorizes engineering organizations to realize the approved Governance System through controlled Engineering Baselines.

Delegation shall not be interpreted as a transfer of constitutional ownership or constitutional authority.


16.7 Constitutional Protection

To preserve long-term governance stability, constitutional authority shall remain protected under Configuration Control.

Accordingly:

  • constitutional governance shall remain stable;
  • engineering realization shall evolve through Engineering Baselines;
  • constitutional modifications shall require Architecture Change Control;
  • editorial revisions shall not modify governance semantics.

This separation ensures stable governance and controlled engineering evolution.


16.8 Constitutional Integrity

The Architecture Board shall preserve constitutional integrity throughout the operational lifetime of the Engineering Intelligence Platform.

Constitutional integrity requires that:

  • governance remains internally consistent;
  • governance authority remains singular;
  • governance decisions remain traceable;
  • governance evolution remains controlled;
  • governance evidence remains auditable.

Violation of constitutional integrity shall require formal Architecture Board review.


16.9 Relationship to Engineering Baselines

Engineering Baselines realize constitutional governance but do not redefine it.

The relationship is therefore:

Engineering Baselines derive authority from constitutional governance.

Constitutional governance shall never derive authority from Engineering Baselines.


16.10 Chapter Summary
